The Shimla Municipal Corporation (Cooked food) Bye-laws 1984.
1. Short title and commencement:
(i) These byelaws may be celled the Shimla Municipal Corporation (Cooked Food) Byelaws, 1984.
(ii) These shall come into force after thirty days from the date of their publication in the official Gazettee.
2. In these byelaws the expression “Cooked food” shall mean the articles of food an drink specified in the schedule here to appended.
3. No person shall unaufacture, sell, or prepare or expose for sale cooked food except in premises licensed in this behalf byt he Municipal Corporation in form ‘A’ and no person shall sell any such article by drinking. The licence issued in from -A will be subject to conditions described to in.
4. No premises shall be licensed for the mainfacture rate preparation or exposure for sale of cooked food,-
(a) unless the floor in made of store, cement or other nonobsorbant imprevious materials;
(b) unless the wall any adequately plastered and linewashed;
(c) unless the premises are provided with adequate and ventilation to the satisfaction of the Health Officer of the Corporation;
Explanation:-
No lamp or other light shall be used in any press which is likely by reason of its construction or condition to cause smoke or soot.
(d) unless the premises are provided with a drain and the whole floor is so sloped as to allow all liquids to flow off the drain;
(e) If there is direct communication between the preraul any form used as a sleeping in room;
(f) If there is any/latrine, cesspool, cowshed, stable any other place in such close proximity of the premises as in the opinion of Health Officer of the Corporation in rendered it undersirable that such place should be used for the manufacture, sale, preparation or exposure for sale of cooked food;
(g) if simple provision is not made for the exit of smoke or other offensive gases enitted during the process if cooking;
(h) if a proper place of sanitary pattern approval by the Health Officer of the Corporation is not provided for washing hands and for washing and cleaning of vessels, receptacles, utensils and other such thing used;
(I) Unless a receptacle of sanitary type approved by the Health Officer of the Corporation is provided on the premises for the collection of waste material and other rubbish; and
(j) unless the drainage of the premises is connected with te recognised system of drainage; if in existance the neighbourhood or as may be requested by the Health Officer of the Corporation.
5. For a license issued under bye-laws 3, a fee as may be prescribed by the Municipal Corporation Shimla ir if the license is taken out for any period less than a year, as may be prescribed by the Municipal Corporation Shimla for amonth or portion there of shall be paid. No license shall be valied beyound 31st day of March rext following the date of issue.
Note:-
This restriction shall not apply to licenses issued in March for the next financial year.
6. Any person who commits a breach or an abetment of a of these byelaws or the conditions of his license shall on conviction by a Magistrate, be punishable with a fine may extend to five hundred rupees and, in the case of continuing breach, with a further fine which may extend to twenty five rupees for every day after the first during which the breach continues.
7. In addition to the penality provided in bye-laws 6 any licensee who commits a breach of any of the conditions his license shall also be liable to have his license sended or revoked by the Municipal Corporation.
8. Reneal and Savings: The byelaws published by the Punjab Government vide Notification No. 2018-C-47/12715 dated 17.5.1947 applicable to the Municipal Corporation Shimla are hereby repealed. Provided that anything done or any action taken under the provisions of the bye-law so repealed shall eb deemed to have been lone, or taken under the corresponding provisions of these bye-laws.

CONDITIONS
1. The licensed premises shall be kept structurally fit for the purpose for which the license is granted. Explanation:- Structural fitness shall be deemed to include:-
(a) the existance of a floor made of stone, cement or other non-absorbent impervious material,
(b) possession of walls propertly plastered all limewashed
(c) adequate provision of light and ventilation and
(d) suitable drains.
2. There shall be no direct communication between the premises and any room used as a sleeping room, and there shall be no latrine, cesspool, cowshed, or stable or other in such close proximity of the premises as in the opir theHealth Officer of the Corporation renders it unless that such place should be used for the manfacture, sale preparation or exposure of cooked food.
3. The licensee shall not emply or permit to be employed in the manufacture, preparation, sale or exposure for sale of cooked food, any person suffering from infecting or contagious disease, or from loathsere sores or who he recently been attending on any person so suffering, and he shall not allow any such person to enter or remain upon the licensed premises. He shall also not allow any animal to enter in the licensed premises.
4. The licensee, shall keep all vessels, utensiles, receptacles and other things used in the manufacture, preparation to exposure of cooked food in a State of cleanliness and shall protect from dust and flies, by making use of/win gauge frames or glass show cases all materials used in such manufacture or perparation for sale of articles manufactured or prepared for sale to the satisfaction of the Health Officer of the Corporation.
5. The licensee shall daily cause to be thoroughly washed and cleaned the floor and drain of the licensed premises and every bench, counter, table,shelf or other place of which articles manufactured, prepared or exposed for sale or any material used in such manufacture, preparation exposure for sale are kept.
6. The licensee shall cause the walls of the licensed premises to be properly lime-washed at least twice any and more often if so repired by the Health Officer of the Corporation.
7. The licensee shall not carry on or permit to be carrie on any other trade of occupation in the licnesed premises except the manufacture, reparation sale or exposire for sale of cooked food, in case, however of premises us for the retail sale of “Ghee” biscuts, confectionery lemon rops etc. sharbats, and indigenioud druge and decetions prepared by cooking, this condition may be relaxed bythe Municipal Corporation at this option.
8. The licensee shall not spit or smoke or suffer any other person to spit or smoke at the place where the manufactureor preparation of cooked food is carried on.
9. Bedding, soiled clothes & artciles not connected with manufacture, or preparatio or exposure foe sale of cooked food shall not be kept in thelicensed premises.
10. The licensee shall not use or permit to be used in such manufacture or preparation for sale any water except water obtained from Municipal Supply laid in direct pipe connection on the premises and stored in the premises in a manner approved by the Health Officer of the Corporation provided also that all such water used on the premises hahall be treated with such substance and such strength as may be determined by the Health Officer of the corporation to ensure purity of water to avoid spread of disease.
11. The licensee shall not permit any cooked food to be wrapped in dirty or soiled paper, cloth or leaves.
12. If required by the Corporation Health Officer, the licensee shall present any person employed on the premises to betested for the purpose of ascretaining whether he is a carrier of any infections disease, such tests shall be made at Municipal expenses. The license shall submit himself and his employees, if any for T.A.B. inoculation against enteric group of fevers which will also be done at Municipal expenses.
13. The licensee shall provide a receplace of sanitary by approved by the Health Officer of the corporation at a place fixed for the purpose of ......... of waste material and other rubbish.
14. The licensee shall provide proper price for washing have and for washing and cleaning of vessels, receptacles, utensils and other such things used.
15. The licensee shall make ample provision for the exi.. of smoke or offensive gases emitted during the process cooking.
16. The drainage of licensed premised shall be connected with the recongnised system of drainage if any in exist in the immediate neighbourhood or as may be required by the Health Officer of the Corporation.
17. The licensee shall not import, manufacture sell or prepare or expose for sale cooked food containing any colouring matter which is injurious to the health of human being.
Explanation:- The following colouring matters shall no be added:-
(I) Autimony, Copper, mercury, cadmium chromium, zinc and
(ii Coaltar dyes

18. The licensee who uses banaspatine or charbini in ht epreparations of cooked food shall eribit in a prominent on the premises a sign-board to the effect in English Urdu, Hindi & ................
19. The licensee shall not use any ..................achare of of articles contanining...................... vegetable ............unless it is ............................... china or gre......... or it is enamalled,.......................... electroplaced.
20. The licensee shall not place any pan contaning misri in a street or lane or near a drain.
21. The licensee shall keep cooked food in such a manner tht it does not decompose or lateriorate or become poisonous or contaminated from any source what soever.
22. The licensed premises shall be opened without notice and at all reasonable times to inspection by the Health Officer of the Corporation or any other officer empowered in this bahalf.
23. The licensee shall cimply with all notices issue dby the Health Officer of the Corporation in respect of sanitation.
24. The licensee shall maintain a nominal roll of all of his employees who have undergone T.A.B. inoculation against enteric group of fevers showing name, parents name, amd date of inoculatior.
25. Articles found unfit for human consumption shall be destroyed at the spot without giving any notice in advance by the Health Officer of Corporation or the officer/officials authorised in this bahalf by the Municipal Corporation.
