SHIMLA MUNICIPAL CORPORATION (CONTROL OF DOGS) BYE-LAWS 1984.
SHORT TITLE AND COMMENCEMENT.
1. (i) These Bye-Laws may be called the Shimla Municipal Corporation (Control of Dogs) Bye-Laws, 2004.
(ii) They shall come into force from the date of its publication in the official Gazette.
2. In these Bye-Laws, unless the context otherwise requires:-
(i) “Act” means the Himachal Pradesh Municipal Corporation act, 1979 (Act No. 9 of 1980)
(ii) “Section” means a section of the Act.
3. The owner of every dog kept or brought within the limits of Shimla Municipal Corporation shall on or before the Ist day of April in each year or within seven days of its arrival, register the dog at the office of the Municipal Corporation on payment of Rs. 50/- as registration fee.
4. The form for registration shall be provided on an application at the office of the Municipal Corporation.
5. On receipt of the form of registration duly filled in at the office of the Municipal Corporation, the owner shall be supplied by the Corporation with a metal ticket.
6. The period for which the registration shall hold good shall be for the 12 month from the 1st April to next 31st March in each year.
7. The owner shall cause the dog to wear at all time a collar with the metal ticket supplied, firmly secured thereto.
8. Any dog not wearing metal ticket of registration in accordance with clause 7 of these bye-laws may, if found in any public place be removed and will be liable to be dealt under the orders of the Veterinary Public Health Officer, Municipal Corporation, Shimla. If not claimed within 7 days by the owner.
9. For the purpose of these bye-laws any person in possession or charge of a dog during the absence of the owner from the limits of M.C. Shimla shall be held to be the owner of the same.
10. Any contravention of these bye-laws shall be punishable with a fine which may extend to Rs. 200/- but shall not be less than Rs. 50/- and in case of continuing breach additional fine which may extend to rupees 25/- for every day during which such contravention on breach continues.
11. The above bye-laws shall not apply to such dogs which are brought within the limits of Municipal Corporation, Shimla for show purpose and are certified as such by the Secretary of the Shimla Dog Show. Provided that such dogs are not kept with in the limits of Municipal Corporation Shimla for more than one week.
12. The bye-laws confirmed by the Punjab Government vide their Notification No. 255 dated the 7th April, 1913 which are force within the limits of Municipal Corporation, Shimla are hereby repealed.
(2) Not with standing such repeal anything done, or any action taken in exercise of the powers conferred by or under the bye-laws so repealed shall be deemed to have been done or taken in exercise of the powers conferred by or under these bye-laws as if these bye-laws were inforce on the day on which such thing was done or was taken.
