SHIMLA MUNICIPAL CORPORATION JOB HORSE OR PONIES

BYE LAWS 2004

Short title and commencement 

1. (1)These bye-laws may be called The Shimla Municipal    Corporation” JOB HORSE or ponies BYE LAWS”, 2004

(2) These shall come into force with immediate effect.

Registration of Job Horses and Ponies.

2. Every person who let out on hire horses or ponies for ridding purposes for any period of time within the limits of the Shimla Municipal Corporation shall as hereinafter provided, register the same and take out a license for each animal. Such horses or ponies shall be hereinafter respectively referred to as job horses or ponies.

Grant of License.         

3. Such licenses shall be granted in the form appended to these bye-laws by the Commissioner or by an officer/official authorized by him.

Qualification for getting license and token fee.

4. No job horse or pony shall be licensed if it is under the age of three years  or if it is not in every respect sound, healthy and in good working condition, and if it has not been approved together with its saddlery, bridle and other gear by the Commissioner, Municipal Corporation, Shimla or such other officer/official appointed by him in this behalf and unless the owner thereof has paid a license fee of five hundred rupees for every such horse or pony provided that if the period during which the license is to remain enforce does not exceed six months, fee of only two hundred fifty rupees  shall be levied or any other rate fixed by the Commissioner from time to time.

EXPLANATION

For the purpose of licenses the calendar year shall be reckoned  from the first of April to the 31st of March in the following year.

It shall be lawful for such approving officer of officials, if he deems fit to require any owner of horse or pony,. Brought to be registered and licensed as a job horse or pony, to satisfy  himself  regarding freedom from vice of such animal or the soundness of such animal, and the said approving officer of official may further, if he deems it necessary, require the said owner to produce a veterinary- certificate or soundness and age from the officer-in-charge of the Civil Veterinary Hospital Shimla.

Prohibition  regarding ill- treatment to horse and pony.

5. No proprietor of any horse or pony, kept for hire within the Municipal limits or his servants shall ill-treat or ill use or allow any person to ill treat or ill use such animal.

Power of Inspection and entry into premises

5. It shall be lawful for any person, named in bye-laws 3 above and the officer-in charge of the Civil Veterinary Hospital, Shimla to enter any premises in which a job horse or a job pony is kept or stabled in order to inspect the saddlery and other things used in connection with the said animal, and generally to carry out any of the provisions of these bye-laws. No owner or occupier of such premises shall refuse to permit such inspection or obstruct the inspecting officer in making such inspection, or refuse him permission to enter the premises.

Maintenance of saddlery.

7. The saddlary belonging to or used in connection with every job horse or job-pony shall always be maintained in good order and in thoroughly serviceable condition.

Revocation of license.    

8. Every license issued under these bye-l;aws shall continue enforce during the period for which it is granted, but it shall be in liable to revocation within that time, by order of the Commissioner, Municipal Corporation Shimla, if the proprietor of the animal with respect to which the license has been issued has been guilty of breach of any of these bye-laws or of the conditions  upon which the license has been granted and if these are not fully observed and maintained, or if the job horse or job pony, by reason of vice, sickness, overwork, physical defect, unsoundness, or for any other similar reason has in the opinion of the Commissioner being rendered or has become unfit to be used as a job horse or pony.

Renewal of License.

9. Application for the renewal of a license shall be made in March each year and a fresh license shall be granted in the same manner as is provided in bye-laws 3 and 4 on payment of the same fee as for the original license.

Duties of syce in charge of job horse and pony.

10. Every syce in charge, of a job horse or a job pony shall bear on his arm a brass badge (for which he will pay to the Municipal Corporation rupees 50/- which  shall be refunded to him on his returning the badge on the expiry or otherwise sooner termination of the license to which it relates) containing the number of the license, of the job horse or job pony, and shall also carry and produce for the inspection of any person, requiring the same, a list of fares fixed by the Commissioner and also a card showing the number of the license and the descriptions of the animal to which it refers. Every proprietor or agent carrying on business or the proprietor of a job horse or a job pony shall on demand produce his license for such animals and also if required, the list of sanctioned rates for the inspection of any member of the Municipal Corporation,  Commissioner, Municipal Corporation and any officer/official  authorized by the Commissioner,  Municipal Corporation Shimla, Police Officer or Magistrate or any hirer or intending hirer of such job horse or job pony.

Duty for providing the hiring of horse and pony.    

11. No proprietor of a licensed job horse or job pony shall without reasonable and sufficient cause refuse such animal for hire, the burden of providing which shall be on him.

Fare-hoops of  job horse to be bended with letter “M.C.”     

11. Every job horse that is licensed shall be brought to the Civil Veterinary Hospital to have its fore-hoops bended with the letter “M.C.” and the license number within three days of the license having been issued.

Rate to be charged.        

13 The rates to be charged for the hire of a licensed job-horse  or job-pony shall be fixed by the Commissioner from time to time.    

14. No job horse or pony  shall be parked by the Licensee on the Ridge or riding/ photography purposes except the space ear marked to them.

Penalties for breach  of  bye-laws. 

15. Any person, who commits a breach of bye-laws shall on conviction by a  Magistrate be punishable under Section 396 of the HP Municipal Corporation Act, 1994 with fine which may extend to Rs.500/- and if the breach is continuing breach, with a further fine which may extend to Rs.50/- for every day after the first during which the breach continues.

Repeal and Savings        

16. The Byelaws contained in notification No. 3957-C-40/47816 dated 26.11.1940, which are applicable in the Municipal Corporation Shimla are hereby repealed. Provided that anything done or action taken under the Byelaws, so repealed shall be deemed to have been done or taken under the corresponding provisions of these bye-laws

CONDITIONS OF LICENCE ON THE BACK OF THE LICENCE FORM

1. Every license for  hire  should have the  hoof branded as high up as possible with a mark to be approved by the Commissioner and with the serial number of horse licensed.

2. Every holder of a license should produce his horse at the end of three months from the date of each inspection to the Vety. Health Officer,  MC Shimla.

3. License holder will be served with one reminder on a failure to produce their horses for inspection on the correct date.

4. Failure to comply with the condition laid down in the license will result in  cancellation or suspension of the license.

5. Every Licensee shall submit two copies of his photograph alongwith the photograph of his Horse/Pony at the time of submission of his application.

6. Every Licensee shall run his horse/pony for riding at the Ridge on the line marked for it. Riding will not be permissible beyond the points of the Ladies Toilet opposite Gaiety building.

7. Every Licensee will ensure to make his own arrangements to remove the dung (leed) immediately at his own expenses. It will be compulsory for each horse owner to keep broom and tough all the time for the collection of horse dung (leed)

8. Riding time of horse/pony especially at the Ridge will be in the Summer from March to October in morning from 9 AM to 8 PM and in winter from November to March from 10 AM to 6 PM.
