LEGAL CELL

The Municipal Corporation, Shimla has set up a Legal Cell for filing and defending the Court cases on behalf of the corporation in the competent Courts like Hon’ble Supreme Court, the High Court of HP, H.P. Administrative Tribunal, Session Court, Consumer Forum, revenue Courts and the Court of Collector, M.C. Shimla.  The role of Law Branch is of advisory nature to aid and advise the different wings of the corporation in legal issues. The Corporation has made the provision of one  Legal Advisor-Cum-Prosecutor and one Law Officer for looking after this work. They are entrusted the task of pleading and safeguarding the interests of the Corporation in the courts. They also act as legal advisors to the corporation. In addition, they also assist the officials by providing legal opinions on complicated legal issues of the corporation.

At present, there are more than 903 cases pending for adjudication in different Courts. The Corporation has also engaged the services of 11 lawyers to defend the cases on behalf of the Corporation. They are supervised by the Legal Advisor-Cum-Prosecutor and the Law Officer of the corporation.

This branch has establishment of 8 employees besides one Sr. Assistant who deals with establishment and miscellaneous matters of legal cell.  The record pertaining to the concerned cases is also being maintained by the Sr. Assistant with the assistance of clerical staff who further put up all the PUC’s and files to the concerned LAP and LO for further orders

In the Corporation there are various types of litigation concerning unauthorized constructions, public interest litigations and consumers related litigations and  the matters pertaining to the  realization of lease money or rental value.
