SHIMLA MUNICIPAL CORPORATION STABLES AND COW HOUSES BYE LAWS, 1985.

Short Title & Commencement:-

1. These Bye-laws may be called the Shimla Municipal Corporation stables and Cow Houses Bye-laws, 1985.

2. These shall come into force at once after thirty days from the date of their publication in the official gazette.

Definitions:-

In these bye-laws unless & untill there is anything repugnant in the subject or context and

(i)  “Act” means the Himachal Pradesh Municipal Corporation Act, 1979.

(ii)  “Cow house” shall mean any place where oxen (for hire) or mild cattle are kept, and

(iii) "Stable” means any place where oxen ponies or males are kept.

2. USE OF PREMISES:-

No person shall use or permit to be used any premises or part of any premises as a stable or a cow house unless he has obtained a license for such use from the Municipal Corporation. The Health Officer of the Corporation shall be the licensing authority.

CONDITION FOR LICENSE:

 License for the use of any premises or part of any, premises as a stable or cow house shall be issued on an application to the owner or occupier of such premises, subject to following conditions:-

(a) The license shall not keep or permit to be kept in licensed premises at any time any number of animals in excess of the number prescribed in his license or of a description other than that specified in his licence.

(b) The license shall not permit any person to cock in the licensed premises or to use them for human habitation; provided that a certain number of attendants, to be specified in the license may be permitted to sleep on the licensed premises to prevent accidents to the animals.

(c) The licensee shall provide in some convenient places a receptacle or receptacles for dung, litter etc. Such receptacles shall be of such form and such material as the Health Officer of the corporation may direct and shall be of a capacity of not less that 1/2 sq. metres for each animal kept on the premises.

(d) The licensee shall not kept on the licensed premises any litter or dung in such a situation or manor as to pollute or likely to pollute any drinking water. Where litter or dung is required for agricultural purposes, a smooth impervious platform preferable of cement concrete or a pit of suitable size shall be built at least 40 meters away from the stable or cow house, or from any human habitation on which or in which the litter may be stacked preparatory to its being used as a manure,

(e) The licensee shall cause the licensed premises to be cleaned twice daily, before 9 A.M. and before 4 P.M. and to be washed down once every week. All litter, dung rubbish must be removed to the receptacles provided in accordance with condition

 c. above which should be cleaned twice daily or should be disposed of by burning, packing or burying where the services of Municipal staff can not be availed or;

(d) The Licensee shall if the premises to be used as  a cowshed or stable are in an isolated place and if so required by the Health Officer of the Corporation provide incinerator for the disposal of litter, rubbish etc. of a type approved by the Health Officer of the Corporation.

(f)  that the premises are adequately lighted and ventilated with fly proof ventilators and are provided with self closing wire gauge doors and windows,

(g)  that there is no opening from the premises likely to permit direct ventilation therefore into any cooking place or places used for human habitation; and

(h) that there is provided on adequately drained area equal to not less than one-search of the floor area of the premises on which the  cattle may be washed or ot thread during the day.

Number of Animals to be kept in a Premises:-

The Health Officer of the Corporation shall in every licence specify the description and prescribe the number of animals which may be kept in the licenses premises. The number prescribed shall be such that there shall be reserved for each animal a space of not loss that 3.25 meters in length and 2.50 meters in breadth, such space being exclusive of any manager any central or side drain.

Number of Licences to be issued:-

Only one licence shall be granted in respect of any premises not with standing that such premises may be occupied by more than one animal.

Explanation:-

Any building of smaller dimensions than those indicated in bye-laws 4 (A) and (b) above, and which is already licensed on the date on which these bye-laws come into force may continue to be used provided the corporation is satisfied that the drainage and ventilation are adequate.

Penalty:-

(a) Any license who commits a breach of any of the conditions of his licence shall be liable to being suspended or revoked.

(b) Any person who commits a breach of these bye-laws shall, on conviction obey a Magistrate, be publishable with fine which may extend to rupees two thousand, and if the brach is a continuing one, with a further fine which may extend to fifty rupees for every day after the first beach during which the same continues.

Repeal & Savings:-

Bye-laws published with Punjab Govt. Notification No. 2927-C-40/33235 dated 10th August, 1940 are hereby repealed;

(g) The Licensee shall  cause all the interior walls of the licensed premises to be lime-washed at least twice yearly and more often if so required by the Health Officer of the Corporation.

(h) The licensee shall give every facility to any officer appointed by the Municipal Corporation in this behalf to inspect the licensed premises and the animals kept therein at any reasonable time.

(i)  The Licensee shall inform the Health Officer of the Corporation immediately if it comes to his knowledge, of any out break of any infectious disease among the animal kept on the licensed premises and shall segregate the animals affected pending the order of the Health Officer, of the corporation.

(j) In case the animals kept on licenses premises are milchcattle, the liccense shall cause such animal to be properly washed at least once a week.

(k) The Licensee shall carry out within premises used as Cow-House or stable, as may be  required to be done by the Health Officer of the Corporation.

Conditions for Licensing Premises:-

No Licensee for the use of premises as Cow-Houses or stable shall be issued unless such premises confer to the following conditions.

(a) that the premises are situate at a minimum distance of 10 meters away from any room used for human habitation;

(b) that the premises are fitted with a water tap connected directly with Municipal water supply.

(c) that the height of the premises is in no part less than 3 meters measured from the floor to the wall, plates;

(d) that the floor of the premises is at least 1/2 meter above the level  of the open space or street on the which they open, is paved with some impervious material at least 11.50 m. thick and is sloped away from the heads of the animals to be stabled with a gradient of not loss than one in thirty.

(e) that the premises are adequately drained by a pucca cemented and properly sloping drain into a soakage pit set apart for the purpose and constructed and maintained according to directions given by the Health Officer of the Corporation;

Provided that anything done or any action taken under the provisions of the Bye-laws so repealed, shall be deemed to have been done or taken under the corresponding provisions of these Bye-laws.
